Scanpik Terms of Service

1. About These Terms

Scanpik ("the App," "we," "us") is an iOS app that lets you scan product barcodes, view and write reviews, and contribute product information. These Terms of Service ("Terms") govern your relationship with Scanpik. By downloading, installing, signing in, or otherwise using the App, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the App.

2. Eligibility

The App is not intended for children under 13. If you are under 13, do not use the App. If you are between 13 and the age of majority in your jurisdiction, please obtain your legal guardian's consent before using the App.

3. Accounts

To use the App's main features, you must sign in with "Sign in with Apple" to create an account. Each user may hold only one account. You are responsible for all activity under your Apple ID and your Scanpik account, including sign-in, content you post, and interactions with other users. You may delete your account at any time from the Profile screen in the App.

4. User Content

Content you create ("User Content") includes, without limitation, reviews, ratings, taste profiles, product submissions and edits, product photos, reports, likes, and AI conversation messages.

You retain all rights to your User Content. By submitting User Content, you represent and warrant that:

• you own all rights necessary to upload it, or have obtained the necessary licenses from the rights holders;
• your content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
• your content does not violate any law, regulation, or these Terms.

5. Prohibited Conduct

When using the App, you may not:

• upload content that is unlawful, infringing, harassing, discriminatory, sexual, violent, hateful, or otherwise objectionable;
• post spam, fake reviews, or manipulate reviews, ratings, likes, or product rankings by manual or automated means;
• impersonate any person, vendor, brand, organization, or Scanpik staff;
• create or maintain multiple accounts to evade blocks or abuse features;
• knowingly submit false product information to promote, mislead about, or disparage any brand or product;
• reverse-engineer, scrape, programmatically access, stress-test, or perform security testing on the App or its backend, except with our prior written consent;
• use the App for any activity that violates Taiwan law or the law of your jurisdiction.

6. Content Moderation and Account Termination

We may, but are not obligated to, review, hide, modify, or remove any User Content. Our doing so does not constitute an endorsement of the content's accuracy, legality, or quality.

If you violate these Terms, we may, without prior notice:

• remove or hide your content;
• restrict your access to some or all features;
• suspend or terminate your account.

You may also delete your account from within the App at any time.

7. Intellectual Property

The Scanpik name, trademarks, logo, App interface, source code, design, and related materials are owned by us and protected under copyright, trademark, and related laws. These Terms do not grant you any license to the foregoing except as expressly agreed in writing.

The product names, marks appearing in product images, brand names, and brand logos displayed in the App belong to their respective owners. We display this information only to help users identify products, and we do not claim any trademark or brand rights, nor do we represent any partnership, sponsorship, or affiliation with such brands.

8. Disclaimers

1. Product information is user-generated. Product names, categories, brands, attributes, and photos in the App are created or edited by users. Scanpik does not pre-review each entry for accuracy, completeness, or legality, and does not endorse any specific information.
2. Reviews are the personal opinions of individual users. Ratings, review text, and taste profiles reflect the experience and opinions of the reviewer alone and do not represent Scanpik's position or evaluation of any product, brand, or vendor.
3. No professional advice. The App does not provide medical, nutritional, allergen, safety, legal, or financial advice. For any health or safety decision, rely on official information or qualified professionals.
4. Official sources govern safety information. Product packaging, the manufacturer's official website, and announcements from the Taiwan Food and Drug Administration and other competent authorities are the only authoritative sources for product ingredients, allergens, nutritional content, and safety information.
5. Brands and trademarks belong to their owners. See Section 7.
6. "As is" / "as available." The App and related services are provided on an "as is" and "as available" basis. We do not warrant that the App will be available at all times, uninterrupted, error-free, secure, or fit for your particular purpose, nor that data will not be lost.
7. Brand, vendor, or third-party disputes. If a brand, vendor, or any third party believes specific content in the App (including product information, reviews, or images) is incorrect, false, infringing, or inappropriate, please first use the in-app "Report" feature or email us, and we will address the issue promptly. We encourage collaborative resolution through this channel.

9. Limitation of Liability

To the maximum extent permitted by law:

• Scanpik shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, lost data, or damage to goodwill) arising from your use of, or inability to use, the App.
• Scanpik's aggregate liability to you shall not exceed the total amount you actually paid to Scanpik in the twelve (12) months preceding the dispute.

10. Indemnification

To the extent permitted by law, you agree to indemnify Scanpik against any losses, damages, costs, and expenses (including reasonable attorneys' fees) Scanpik incurs as a result of any third-party claim, suit, or proceeding arising from your breach of these Terms, your violation of law, or User Content that infringes the rights of any third party.

11. Changes to the Service and Terms

We may modify, add, suspend, or terminate all or part of the App's features at any time without individual prior notice. We are not liable for any losses resulting from such changes or termination.

We may revise these Terms from time to time. For material changes, we will update the effective date and notify users through the App or by email. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of them.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China). For any dispute arising out of these Terms or your use of the App, the parties agree that the district court of Scanpik's principal place of business in Taiwan shall have exclusive jurisdiction as the court of first instance.
